DISPUTE RESOLUTION AND ARBITRATION
Any dispute, claim, or controversy arising out of or relating to these Terms, the services provided, or the Business-Airfare website shall be resolved exclusively through binding arbitration administered by the American Arbitration Association, except that individual claims may be brought in a small-claims court of competent jurisdiction.
Class actions, class arbitrations, or representative proceedings are not permitted. By accepting these Terms, you acknowledge that you waive the right to have disputes decided by a judge or jury and waive the right to participate in any class or collective proceeding. Disputes will be decided by a neutral arbitrator, who may grant any relief available in court. Arbitration decisions are enforceable in court and may be overturned only on limited legal grounds.
If this arbitration agreement is found unenforceable, any permitted court proceedings (excluding small-claims actions) shall take place exclusively in the state or federal courts located in San Francisco, California. You consent to the jurisdiction of those courts. These Terms are governed by the laws of the State of California, except that the arbitration agreement is governed by the Federal Arbitration Act.
You may opt out of arbitration by submitting written notice to support@business-airfare.com within thirty (30) days of first accepting these Terms.
