Acceptance of the Terms and Conditions

Welcome to the business-airfare.com website (“Website”). This Website is designed to assist customers in finding travel information, determining the availability of travel-related goods and services, and facilitating customers booking reservations with third-party travel agents, travel suppliers and travel providers, which include, without limitation, airlines, hotels, rental car companies and consolidators (collectively, “Travel Providers”).

The terms “we”, “us”, “our” refer to Business Airfare LLC, with business address 8 The Green Ste B, Dover, Kent County, DE 19901, United States. The terms “you” or “yours” refer to the customer visiting and using the Website.

IMPORTANT: We are not a Travel Provider and do not issue airline tickets ourselves. All reservations you make are made by you with the applicable Travel Providers, not with us. Our facilitation is limited to: (1) presenting information, pricing, and availability provided by Travel Providers for travel-related products and services (collectively, “Travel Products”) and our related consulting/assistance services (“Services”); and/or (2) enabling you to contact applicable travel agents or suppliers (including via phone, email, SMS, WhatsApp, or other messaging) to complete a booking.

The Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (“Terms and Conditions”). Please read these Terms and Conditions carefully before using the Website. You should also read our Privacy Policy, which governs your use of the Website and is incorporated by reference into these Terms and Conditions.

By using the Website or by clicking an “accept” or “agree” button when made available to you, you agree to comply with and be bound by these Terms and Conditions without limitation or qualification. If you do not agree, you must stop using the Website and refrain from making any bookings through the Website.

We reserve the right to deny access to the Website to anyone at any time. We may modify, revise, or update these Terms and Conditions at any time. Changes are effective immediately when posted. Continued use after posting constitutes acceptance of the updated Terms.

In some instances, both these Terms and Conditions and separate terms and conditions will apply, including without limitation, loyalty/referral program terms, terms written on a travel voucher, terms in an email to you, and Travel Providers’ terms and conditions (collectively, “Additional Terms”). If there is a conflict, these Terms and Conditions control with respect to your interactions with Business Airfare LLC unless expressly stated otherwise.

Who We Are, What We Do, and What We Do Not Do

We provide the Services and do not issue airline tickets ourselves. In providing Services, we perform operating activities on the Website, including:

• Website administration and publishing, updating and deleting content and information about possible Travel Products;
• Attracting users and assisting with Website navigation, including connecting them with Travel Providers;
• Providing customer support and, where applicable, redirecting you to the customer support of the relevant Travel Provider.

Only the applicable Travel Providers are responsible for their respective Travel Products. When you make bookings with any Travel Provider, you understand you are booking directly with that provider and will be subject to that provider’s terms and privacy policy. We do not bear responsibility beyond our Services should anything go wrong in your interactions with a Travel Provider or during your travel.

Communications Consent (Phone Calls, SMS & WhatsApp)

By providing your phone number and/or contacting Business Airfare by phone, SMS, WhatsApp, or other messaging services, you agree that we may contact you for purposes related to your requests and our Services. These communications may include:

• Responding to price quote requests and itinerary inquiries;
• Clarifying traveler details, dates, names, preferences, and travel constraints;
• Sharing deal options, confirmations, payment link details, and time-sensitive updates;
• Customer support, service notices, and administrative messages;
• Restoring communications that were interrupted or accidentally closed in chat/messaging.

Text messages (SMS) and WhatsApp: If you start or continue a conversation with us via SMS or WhatsApp, you understand that messages may be delayed, interrupted, closed, or removed depending on device and app behavior. Where appropriate, we may follow up via SMS, WhatsApp, phone call, or email to continue the conversation or provide requested service information. No purchase is necessary.

Opt-out: You may opt out of SMS at any time by replying STOP (where supported) or by contacting us at support@business-airfare.com. You may also ask us to stop contacting you via WhatsApp or phone. Please note: even if you opt out of marketing messages, we may still send essential service or administrative communications related to your active request, booking, payment, or legal obligations.

Message and data rates may apply depending on your carrier/plan. Availability of opt-out keywords can vary by country and carrier.

Use of the Website

By using the Website, you represent, warrant, and agree that:

• You are responsible for making all arrangements necessary to access the Website.
• You are of sufficient legal age in your jurisdiction to create a binding legal contract with Travel Providers.
• You have read and understand these Terms and Conditions and agree to be bound by them.
• You are financially responsible for all bookings and purchases.
• All information you supply is true, complete, and correct, and you will update it if it changes.
• If you book for someone else, you will inform them of these Terms and Conditions and any applicable Additional Terms and obtain their agreement.
• If you act for others named in a booking, you accept these Terms on behalf of all such persons and are responsible for ensuring their consent.

If you have a personal account on the Website, you will safeguard your account information (if any) and are responsible for all activity under your account. You agree to notify us immediately of unauthorized access or any breach of security and to log out at the end of each session.

We may deny access to anyone at any time, for any reason, including for violation of these Terms and Conditions.

Prohibited Activities

The content and information on the Website and the infrastructure used to provide such content are proprietary to us and/or Travel Providers. You may make limited copies of your itinerary for travel purposes, but you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell/re-sell any content, software, Travel Products or services obtained from or through the Website.

You specifically agree not to:

• Use the Website or its contents for any unlawful purpose or any commercial purpose.
• Make speculative, false, or fraudulent reservations.
• Access, monitor, or copy Website content using robots, spiders, scrapers, or automated means without written permission.
• Bypass robot exclusion headers or other measures used to prevent or limit access.
• Take actions that impose an unreasonable load on our infrastructure.
• Deep link to any portion of the Website (including purchase paths) without written permission.
• Frame, mirror, or incorporate any part of the Website into another website without authorization.

If your use shows signs of fraud, abuse, or suspicious activity, we may suspend, terminate, or restrict access at our discretion. We reserve the right to take legal action if fraudulent activity is suspected.

General Information About Booking Through Us

Rates displayed on the Website are obtained from Travel Providers or their agents. We cannot guarantee displayed prices. Prices change constantly and additional charges (payment fees, service fees, taxes, and other charges) may apply in your actual booking.

Airline tickets booked through Travel Providers are typically issued as e-tickets. After booking, you should receive confirmation with booking reference number(s). We do not provide paper tickets.

If you have disputes relating to Travel Products, you agree to address them with the Travel Provider directly. Our responsibility is limited to our Services.

Travel Providers’ Additional Terms

Additional Terms apply to your reservations and purchases with Travel Providers. Please read them carefully, including the carrier’s conditions of carriage for airlines. You agree to abide by the Travel Provider’s rules, restrictions, and payment requirements. You can read full information on our additional terms here.

Airfare may be guaranteed only after purchase is completed and tickets are issued. Travel Providers may cancel bookings if full payment is not received on time. Currency conversion displayed on the Website is informational only and may differ from the amount charged by your payment provider, including fees and taxes.

Some Travel Providers may require liability waivers. Violations of Travel Provider rules may result in cancellation, denial of access, forfeiture of payments, and/or additional charges by the Travel Provider. These matters are outside our control.

Links to Third-Party Websites

The Website may contain links to third-party sites (including Travel Providers). We do not control these sites and are not responsible for their content or practices. Use them at your own risk and review their terms and privacy policies before use.

Intellectual Property

The Website and its contents are owned by Business Airfare LLC, our licensors, or other providers and are protected by applicable intellectual property laws. These Terms permit use for personal, non-commercial purposes only.

• Your computer may temporarily store copies in RAM incidental to viewing.
• Your browser may cache files for display enhancement.
• You may print/download a reasonable number of pages for personal, non-commercial use only.

You must not:

• Modify copies of materials from the Website.
• Use illustrations/photos/video/audio separately from accompanying text.
• Delete or alter copyright, trademark, or proprietary notices.
• Use any part of the Website for commercial purposes without written permission.

Limitations of Liability

All information on the Website is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose.

Under no circumstances shall we be liable for any damages, viruses, loss of data, injury, loss, claim, or any special, punitive, exemplary, direct, indirect, incidental, or consequential damages arising out of or connected with your use of, or inability to use, the Website or information on it, even if advised of the possibility.

Some jurisdictions do not allow certain limitations. Where prohibited, limitations apply to the fullest extent permitted by law.

We act as an information and consulting intermediary and are not liable for Travel Providers’ products or services. Any reliance on Website content is at your own risk.

Waiver and Release

By using the Website and/or our Services, you irrevocably waive and release Business Airfare LLC and its affiliates, licensors, service providers, and their respective officers, directors, employees, contractors, agents, suppliers, successors and assigns (collectively, the “Parties”) from claims relating to:

• Any defect, negligence, wrongful act/omission, or failure of performance by any Travel Provider;
• Inconvenience, loss of enjoyment, or mental distress;
• Delayed departures, missed connections, substitutions, service terminations, or fare changes;
• Cancellations or double-bookings beyond our reasonable control;
• Claims arising from transportation or travel services performed (or not performed) in connection with your itinerary.

For avoidance of doubt, we assume no liability for cancelled flights, missed flights, or missed connections due to airline schedule changes.

Indemnification

You agree to defend, indemnify, and hold harmless Business Airfare LLC and all Parties from and against claims, damages, losses, liabilities, costs, and expenses (including reasonable legal and accounting fees) arising out of: (i) your breach of these Terms; (ii) your use of the Website; or (iii) your dealings with any Travel Provider.

Release (Travel Provider Disputes)

If you have a dispute with a Travel Provider, you release Business Airfare LLC and the Parties from all claims arising out of or related to such dispute.

Personal Data and Privacy

All information we collect is subject to our Privacy Policy. By using the Website, you consent to actions taken by us with respect to your information in compliance with the Privacy Policy.

Governing Law and Jurisdiction

To the fullest extent permitted by law, any disputes arising out of or relating to the Website and/or our Services shall be governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Travel purchases are governed by the applicable Travel Providers’ terms and the laws specified therein.

Any legal action relating to these Terms must be brought in your individual capacity and not as part of a class action, consolidated, or representative proceeding.

You agree to send us a written notice of any dispute (“Notice”) to allow a good-faith attempt to resolve it. The Notice must describe the nature and basis of the claim and the relief sought. Send Notice to: support@business-airfare.com. If we cannot resolve the claim within thirty (30) days of receipt, you may pursue other remedies subject to these Terms and applicable law.

Waiver and Severability

No waiver by us of any term shall be deemed a further or continuing waiver. If any provision is held invalid or unenforceable, remaining provisions will remain in full force and effect.

Entire Agreement

These Terms and Conditions and our Privacy Policy constitute the entire agreement between you and Business Airfare LLC regarding the Website and supersede all prior understandings.
